New Album Favourites to Smart Albums not working

Hi
Smart Albums now being able to pick up the favourites list in the gallery just isnt working I'm afraid
Its picking up maybe 20% of the galleries that I have live that I know have favourites
Are you aware that it doesnt work or is there a knack to getting it to work?
